Terms of Use

These terms apply when you use AuraCoLiving ("we", "us"), including the website at auracoliving.com. By creating an account or using the site, you agree to them. Please also read our Privacy Policy. If you do not agree, please do not use AuraCoLiving.

1. What AuraCoLiving is

AuraCoLiving is an online platform where owners and tenants list and find rooms, flats and flatmates. We are an intermediary under section 79 of the Information Technology Act, 2000: we host what users post, but we do not create, check in advance (except as described in section 6) or control it.

• We are not a broker, real-estate agent or landlord, and we are not registered as an agent under the Real Estate (Regulation and Development) Act, 2016. We do not charge brokerage.
• We are not a party to any rental agreement. Any visit, deal, deposit, payment or agreement is between you and the other user.
• We do not verify users' identity, property ownership, or the accuracy of listings, unless a listing or profile clearly shows a badge for a specific check we did. You must make your own checks before visiting, paying or signing anything.
• Listing and searching are free today. If we introduce paid features, their price and refund terms will be shown before you pay.

2. Your account

• You must be 18 or older and able to enter a binding contract under Indian law.
• Give your real name and a mobile number you control. One person, one account. Do not impersonate anyone.
• Keep your sign-in methods (email, Google account, password) secure. You are responsible for activity under your account; tell us straight away if you think someone else has accessed it.

3. Listing a property

• You must own the property or have the owner's written permission to rent it out. If you are a tenant listing a room in the home you rent, you must have your landlord's permission to bring in a flatmate; your listing is shown as "Posted by tenant".
• Listings must be accurate: real photos of that property, the true rent and costs, and current availability. Listings expire after 30 days unless renewed, and you must mark a listing occupied once it is rented.
• Photos must show the property only: no people, no weapons or ammunition, nothing explicit, violent or unlawful, and no posters, logos or screenshots.
• You may state reasonable preferences such as women only, men only, families, working professionals or vegetarian households. You may not exclude people because of their religion, caste, community, race, region or place of origin.
• "Verified" badges are given only after our own checks. Do not claim verification you haven't received.

4. Contacting people

• Use contact requests only to discuss genuine rentals.
• Phone numbers and addresses you receive through an accepted request may be used only for that rental conversation. Do not share them, add them to lists, or use them for marketing.
• Chat is for genuine rental conversations. Do not send abuse, threats, spam, adverts, or requests for money before a visit, and do not ask for OTPs or bank details. The content rules in section 5 apply to every message.
• You can block or report any chat. If someone reports a chat, our team may read that conversation to review the report, and may suspend accounts that break these terms.

Ratings and reviews

• Rate only your own, genuine experience with the person or property, and keep it fair and factual. Do not offer or accept anything in exchange for a rating, and do not threaten to leave a bad one.
• Ratings and replies follow the same content rules as listings (section 5). We may hide ratings that break these rules, after a report or our own review. We do not edit ratings or remove them because they are negative.

5. Content you must not post or share

In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not post, upload, share or send anything that:

• belongs to someone else and you have no right to use;
• is defamatory, obscene, pornographic, paedophilic, invasive of another person's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or encourages money laundering or gambling;
• is harmful to children;
• infringes any patent, trademark, copyright or other proprietary right;
• deceives or misleads about where a message came from, or knowingly shares false or misleading information;
• impersonates another person;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries or public order, incites any offence, or insults another nation;
• contains viruses or other code designed to interrupt, destroy or limit any computer resource;
• is patently false and untrue, written to mislead for financial gain or to cause injury to any person; or
• violates any law in force.

Also not allowed: fake or duplicate listings, charging brokerage while posing as an owner, asking for money before a genuine visit, discriminatory listings (section 3), scraping or bulk-downloading the site, using bots, or trying to access other people's accounts or data.

6. How we keep the platform safe

• Listings and photos are checked before they are published, and text is screened for abusive words and contact details. Changes to a listing's text or photos are checked again.
• Anyone signed in can report a listing. Three reports hide it until we review it.
• We may remove or disable content, and suspend or close accounts, that break these terms or the law, without prior notice. We will act on court orders and lawful government requests within the time the law requires, and we may report illegal activity to the authorities.

7. Grievances and takedown requests

To report content, a privacy concern or a breach of these terms, use "Report this listing" or write to our Grievance Officer, Aditya Bansal, at theauracoliving@gmail.com. We acknowledge complaints within 24 hours and resolve them within 15 days. Complaints about content showing nudity, sexual acts or impersonation of a person are acted on within 24 hours.

8. Stay safe

Always visit a property before paying anything, check the owner's identity and ownership documents, and get a written rental agreement. Never pay a deposit to someone you have not met at the property. The document templates on our site are basic drafts, not legal advice.

9. Your content and our rights

• You keep ownership of the photos and text you post. You give us a non-exclusive, royalty-free licence to host, display and reasonably adapt them (for example, resizing photos) on AuraCoLiving, and to show your listing on our own website and social channels while it is active.
• The AuraCoLiving name, logo, design, text and code belong to us. You may not copy, reproduce or reuse them without our written permission.

10. Indemnity

You agree to compensate AuraCoLiving for any claims, losses, fines or reasonable legal costs that arise because of content you posted, a deal you made with another user, or your breach of these terms or the law.

11. Disclaimers and liability

We work to keep listings accurate and the service available, but we provide AuraCoLiving "as is" and "as available". We do not guarantee the accuracy of listings, the identity or conduct of any user, or the condition, legality or availability of any property. We are not responsible for third-party websites linked from our site. To the extent the law allows, our total liability to you is limited to ₹1,000. Nothing in these terms limits liability that cannot be limited by law.

12. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of our service providers, natural disasters, government action or network failures.

13. Ending your use

You can stop using AuraCoLiving and delete your account at any time from your profile page. We may suspend or close accounts that break these terms. Sections 9 to 15 continue to apply after your account ends.

14. Changes

We may update these terms. We will change the date above and tell signed-in users on the site before significant changes apply. Continuing to use AuraCoLiving after that means you accept the updated terms.

15. General

• These terms are governed by the laws of India. Courts in Chandigarh have exclusive jurisdiction.
• If any part of these terms is found unenforceable, the rest continues to apply.
• If we don't enforce a right straight away, we have not given it up.
• These terms and our Privacy Policy are the whole agreement between you and us about AuraCoLiving.
